Technology and digital improvements have caused a paradigm shift in the gaming business in India. Given the sizeable young population of India, the widespread availability of smart phones, and the ability to access the internet even in remote and rural regions, the online gaming business has already experienced phenomenal growth and has a very bright future. The industry's revenues nearly quadrupled in just four years to reach INR 43.8 billion in FY18, and they are predicted to increase even more, with a CAGR of 22.1% from FY18 to FY23, to reach INR 118.8 billion.

The subject of whether or not internet games are legal in India has become more prevalent as the number of online gaming sites has increased over the past ten years. Regrettably, given the complex legal structure surrounding online gambling, it is difficult to provide a detailed response to the aforementioned topic.

Legal Framework:

  • Gambling and betting in person: The State Legislatures are empowered by the Indian Constitution to draft and pass state-specific "gambling and betting" laws. The Public Gambling Act of 1867 has been enacted in several Indian states, including Uttar Pradesh, Delhi, and Madhya Pradesh, to control gambling operations. The remaining states have passed their own legislation to control gambling in their own regions. Since the majority of these laws were passed before internet gambling and gaming became popular, they mostly refer to and deal with gambling activities that take place in physical locations.

  • Gambling online: Only two Indian states, Sikkim and Nagaland, have laws that specifically enable and regulate online gaming. The Sikkim Online Gaming (Regulation) Act 2008 was passed with the dual goals of regulating and controlling online gambling operations conducted via electronic or non-electronic means, as well as assessing fees for doing so inside the State of Sikkim.

  • Fantasy Sports: Fantasy Sports are online prediction games where users assemble a virtual squad of actual athletes from leagues like the National Basketball Association (NBA), the English Premier League (EPL), the Indian Premier League (IPL), etc.

These online players are known as "Managers," and they put together a team of players for a certain league in order to gain points based on real-world statistics that are then transformed into fantasy points. The more fantasy points earned by the managers, the better the player performs in real life. Every manager competes with rival managers and their teams to win. To continue winning, every manager oversees a roster by adding, removing, trading, and selling players.

  • Lotteries: The Central Government of India has the power to create legislation pertaining to lotteries under the Indian Constitution. The Central Law Lotteries (Regulation) Act, 1998, regulates lotteries, which are no longer covered by gambling legislation. The Lotto (Regulation) Regulations 2010 and state-specific legislation have been created in accordance with this Act. The Supreme Court of India issued a ruling in 2015 giving each state in India the authority to decide whether a game of chance like the lottery is permissible or illegal. There are currently only 13 Indian states where playing the lottery is permitted. Arunachal Pradesh, Assam, Goa, Kerala, West Bengal, Punjab, Madhya Pradesh, Manipur, Meghalaya, Mizoram, Nagaland, and Sikkim are among those states.

  • Social and Casual Gaming: Online games that have no prizes are referred to as casual and social games. With the introduction of arcade gaming devices in western nations like the USA, the idea of casual electronic gaming gained popularity. These arcade games gradually paved the way for video games and "home entertainment" gaming consoles like the Sony PlayStation and Microsoft Xbox series, which are hugely popular today all over the world. The popularity of online computer games has increased significantly as a result of fast internet, different player interfaces, and the simplicity of communication between online players. As a result, there are millions of downloads, which generate millions of dollars in income.

The urgent necessity to protect the interests of online players has been made clear by recent events. Instead of outlawing online games, proper controls and guidelines may be taken into account.
